Victimisation

It is against the law if your employer treats you unfairly for complaining about discrimination or harassment, or helping others to complain.  This is called victimisation. You can complain to the Equal Opportunity Commission about it.

Victimisation could include being sacked, demoted, having your hours reduced, being given a bad reference or anything else that an employer does to retaliate because you complained.

If you are sacked for making a complaint about unlawful discrimination, it could be unlawful dismissal, which can lead to compensation or reinstatement. You need to act promptly after being dismissed as there are time limits to make unlawful dismissal claims.

Anyone who thinks they have been wrongfully dismissed should contact the Fair Work Infoline (13 13 94) or a legal advice service, such as Young Workers' Legal Service.
